The H2A Agricultural worker program should continue without many changes into 2008. We should all be alert to the possibility that the Ag-Jobs bill may pass Congress. If so, there will be an entirely new process to obtain agricultural workers.

Landscapers and other non-agricultural employers who will need foreign workers using the H2B visa should call us immediately for the 2008 season. We believe that all 33,000 H2B visas will be used prior to April 1, 2008

Congress finally acted on the H2B program for fiscal year 2007. On October 1, 2006, returning H2B workers will be allowed visas without regard to the statutory 66,000 visas.

However, employers who do not have returning H2B workers will have to compete for the remaining 33,000 visas which will become available on April 1, 2007. At the moment, we know that this law expires on October 1, 2007.

Should Congress act to provide more visas or alternatives we look forward to better results for all H2B employers in 2007.
